As someone who has no artistic talent, I have to get commissions and generally use a bunch of references to try piecing my character together. The ethical question today comes from where is the line for using other people's art as references?

To clarify, I'm not planning on pointing out someone's else work and going, hey just like that, just change x, y, z. You see, I want to get a commission done of a unicorn satyr character, and I just want to use the piece of an example of how I want the fusion of human to equine legs handled since it's not entirely equine from the waist down. I also wanted to use it for reference of how I wanted the ears done since it was a cute fusion of elf/equine I'd like to have for my character.

My second question is, would you consider it ethical to use AI generated images for references for use in a commission?

Your questions are very clear.
First, using other's art as your reference, if you paid for it, you have rights on it, else the art belongs to the artist.
Except if this art is free of use, than it's up to you if you refer to the artist as the author of the art, for decency matters you do, or at least mention the origin of the art (site xyz, consulted this or that date, a site reference). But you can't sell that art (only if you officially paid for it, to the original author).
If other's art is used as a reference to have a commission done based on that art (like I want something similar to this but with this or that changed), as long as that reference is destroyed or author mentioned, there is no issue, as this is used in private and not public. If it is public, mention the artist is obligatory.
AI generated art is free of use, one can mention the site of the AI, but not necessary. So use AI generated art to get a commission based on that generated art is no big deal, it's free.

Please correct me if I'm wrong, as I neither use AI, nor commissioned art, I make my own sketches the old fashioned way, with paper and pencil <G>
